Acceptance of these terms

dermwax.com (the "Site") is operated by Spa Order, a Delasco company ("Spa Order", "we", "us"). Dermwax is a brand owned by Spa Order. By accessing or using the Site you agree to these Terms of Use. If you do not agree, please do not use the Site.

Professional use only

Dermwax products are professional waxing products intended for use by licensed skincare and esthetics professionals in accordance with applicable state and local licensing requirements. Nothing on the Site should be read as authorizing anyone to perform services they are not licensed and trained to perform.

Information only, not instruction or advice

The Site describes our product lines, textures, finishes and ingredients so you can choose products. It is general brand information. It is not training, certification, technical instruction, medical advice or a substitute for your own professional judgment, your education, your license requirements, or the directions and warnings on the product label.

Guidance such as suggested waxes by body area, consistency comparisons and ingredient notes is offered as a starting point only. Results vary with skin type, hair type, temperature, technique, product handling and client history. You are solely responsible for deciding what is appropriate for each client and for performing appropriate patch testing.

Product safety and labels

Wax is applied hot and can burn. Always follow the temperature guidance, directions, cautions and ingredient information on the product packaging, which control over anything stated on the Site. Discontinue use and seek medical attention if an adverse reaction occurs.

Product formulations, packaging, ingredient lists, availability and specifications may change. The product page on spaorder.com and the physical product label are the authoritative sources at the time of purchase.

No sales on this Site

The Site does not sell products, accept orders, or process payments. All purchases are made on spaorder.com or through an authorized distributor, subject to that seller’s own terms of sale, pricing, shipping and return policies. Any prices, promotions or shipping thresholds mentioned on the Site are illustrative and may change without notice.

Distributor listings

The Site lists independent third party distributors as a convenience. Those businesses are not owned or controlled by Spa Order. A listing is not an endorsement, warranty, agency relationship, joint venture or partnership, and we make no representation about any distributor’s pricing, inventory, service or conduct. Your dealings with a distributor are solely between you and that distributor.

Distributor information, including locations and availability, may be incomplete or out of date. Confirm details directly with the business before relying on them.

Accuracy and availability

We work to keep the Site accurate but do not warrant that it is complete, current or error free. We may change, suspend or discontinue any part of the Site, including any product information, at any time without notice. Typographical errors and omissions may be corrected without liability.

Intellectual property

The Site and its contents, including the Dermwax and Spa Order names and logos, product photography, packaging designs, text, layout and code, are owned by Spa Order or its licensors and are protected by trademark, copyright and other laws. You may view and print pages for your own internal business reference.

You may not otherwise copy, reproduce, republish, distribute, modify, frame, scrape, data mine or create derivative works from the Site or use our marks without our prior written permission. All rights not expressly granted are reserved.

Acceptable use

You agree not to use the Site in any way that is unlawful, infringing or harmful, and specifically not to:

• Interfere with or disrupt the Site, its servers or its security
• Attempt to gain unauthorized access to any system or data
• Use automated means to scrape, harvest or index content except by standard search engine crawling
• Misrepresent your identity, licensure or affiliation with Spa Order
• Use our content or marks in a way that suggests endorsement or partnership

Disclaimer of warranties

THE SITE AND ALL INFORMATION ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR FREE OF ERRORS OR HARMFUL COMPONENTS.

Any warranty applicable to a Dermwax product is provided at the point of sale by the seller and is not created or expanded by the Site. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPA ORDER, DELASCO AND THEIR OFFICERS, EMPLOYEES, AGENTS AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST REVENUE, LOST DATA, BUSINESS INTERRUPTION, PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR YOUR RELIANCE ON ANY INFORMATION ON IT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100). THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY AND ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to indemnify, defend and hold harmless Spa Order, Delasco and their affiliates from and against any claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys’ fees, arising out of your use of the Site, your violation of these Terms, or your provision of services to clients, including any claim relating to a waxing service you perform.

Third party sites

The Site links to spaorder.com, distributor websites, social media and other third party resources. We do not control those sites and are not responsible for their content, products, policies or practices. Following a link is at your own risk.

Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. You agree that any dispute arising out of or relating to the Site or these Terms will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts.

Any claim must be brought within one year after it arises, to the extent permitted by law. If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and the unenforceable provision will be limited to the minimum extent necessary.

Changes to these terms

We may revise these Terms at any time by posting an updated version with a new date. Your continued use of the Site after a change means you accept the revised Terms.
